1. IDENTIDAD DEL PRESTADOR
Este sitio, lauriertremblay.com (el “Sitio”), es operado por Laurier Tremblay, Asesor Inmobiliario afiliado a Baja Surf Realty, razón social GRUPO BSR S DE RL DE CV. 2. ACEPTACIÓN Y USO
Al acceder o utilizar el Sitio, usted acepta estos Términos. Si no está de acuerdo, no utilice el Sitio. El Sitio se ofrece para consultar información inmobiliaria y contactar a Laurier Tremblay. No puede utilizarse para actividades ilícitas, extracción automatizada no autorizada, interferencia técnica ni reutilización comercial no autorizada.
3. INFORMACIÓN, NO CONTRATO NI PAGO
El Sitio no acepta pagos, depósitos ni la celebración de contratos. Enviar un formulario, solicitar información, guardar una propiedad o recibir una respuesta no crea una relación cliente-asesor, representación, comisión, reserva, promesa de venta ni obligación de comprar o vender. Cualquier relación profesional o operación requiere documentos separados y, cuando corresponda, la intervención de la correduría, notario y demás profesionales.
4. LISTADOS, IDX Y MLS
Los listados pueden provenir de IDX, MLS BCS, FlexMLS, iHomefinder, propietarios, desarrolladores u otras fuentes. La disponibilidad, precio, características, imágenes, medidas y estado pueden cambiar sin previo aviso y deben verificarse antes de tomar una decisión. Las pantallas IDX deben identificar a la oficina captadora y mostrar los datos de atribución exigidos por el MLS. Algunos listados mostrados por cortesía del programa IDX pueden no ser listados de Laurier Tremblay o Baja Surf Realty. El contenido MLS/IDX se permite únicamente para uso personal y no comercial relacionado con una posible compra, venta o arrendamiento. 5. PUBLICIDAD, PRECIOS Y MONEDA

Cuando un precio se muestre en dólares estadounidenses, cualquier equivalente en pesos mexicanos es informativo y debe calcularse con el tipo de cambio aplicable en la fecha correspondiente. El precio, forma de pago, gastos de cierre, impuestos, cuotas, inventario, características y condiciones finales deben confirmarse por escrito. Ninguna fotografía, plano, render, estimación, traducción o descripción sustituye la documentación contractual o registral.
6. NO ASESORÍA LEGAL, FISCAL, FINANCIERA O DE INVERSIÓN
El contenido es informativo. No constituye asesoría legal, fiscal, financiera, migratoria, técnica, valuatoria ni garantía de rendimiento. Antes de decidir, consulte a profesionales independientes y realice la debida diligencia, incluyendo título, gravámenes, uso de suelo, permisos, condición física, servicios, régimen condominal, costos y riesgos cambiarios.
7. COMUNICACIONES Y CONSENTIMIENTO
Cuando usted solicita información, Laurier puede responder por el medio que usted proporciona para atender esa solicitud. Esto es distinto del marketing opcional. Los correos, llamadas o mensajes de texto promocionales sólo se enviarán cuando exista consentimiento aplicable. Puede revocarlo en cualquier momento escribiendo a laurier@lauriertremblay.com. El consentimiento de marketing no es condición para recibir respuesta a una consulta ni para adquirir servicios. Pueden aplicar tarifas de su operador de telefonía.
8. PRIVACIDAD
La recopilación y el tratamiento de datos personales se rigen por el Aviso de Privacidad disponible en https://www.lauriertremblay.com/privacy-policy. El consentimiento para una finalidad secundaria se solicita en el punto de recopilación correspondiente; el simple uso del Sitio no equivale a aceptar marketing opcional.
9. PROPIEDAD INTELECTUAL
Salvo el contenido perteneciente a MLS, IDX u otros terceros, el texto, diseño, marcas, fotografías y demás contenido del Sitio pertenecen a Laurier Tremblay o se utilizan con autorización. No se concede licencia salvo el uso personal necesario para consultar el Sitio.
10. ENLACES Y SERVICIOS DE TERCEROS
El Sitio puede incorporar o enlazar servicios de Squarespace, iHomefinder, MLS/FlexMLS, mapas, redes sociales y otros proveedores. Sus contenidos, disponibilidad y prácticas se rigen también por sus propios términos. Laurier no controla sitios de terceros, pero esto no limita los derechos que la ley le reconoce frente a Laurier cuando resulten aplicables.
11. DISPONIBILIDAD Y SEGURIDAD
No se garantiza que el Sitio esté libre de interrupciones, errores o componentes dañinos. Usted es responsable de usar dispositivos y conexiones razonablemente seguros. Laurier puede modificar, suspender o retirar funciones por mantenimiento, seguridad o cambios del proveedor.
12. LIMITACIÓN RAZONABLE DE RESPONSABILIDAD
En la medida permitida por la ley, Laurier no responde por daños indirectos, incidentales o consecuenciales que resulten exclusivamente del uso informativo del Sitio o de interrupciones fuera de su control. Esta limitación no excluye responsabilidad por dolo, culpa grave, fraude, lesiones, incumplimiento de obligaciones legales, publicidad engañosa, ni cualquier derecho o remedio irrenunciable del consumidor. Nada en estos Términos limita los derechos que usted pueda ejercer ante PROFECO u otra autoridad competente.
13. LEY APLICABLE Y PROFECO
Estos Términos se rigen por las leyes federales de México y las disposiciones aplicables de Baja California Sur. Antes de un litigio, las partes procurarán resolver cualquier diferencia de buena fe. El consumidor conserva el derecho de acudir a la Procuraduría Federal del Consumidor (PROFECO) y a las autoridades o tribunales competentes. Ninguna cláusula impone una renuncia a derechos o jurisdicciones irrenunciables.
14. CAMBIOS Y DIVISIBILIDAD
Las modificaciones se publicarán con una nueva fecha de entrada en vigor y aplicarán prospectivamente. Si una disposición es inválida o inaplicable, las demás continuarán vigentes en la máxima medida permitida.

2. ACCEPTANCE AND USE
By accessing or using the Site, you accept these Terms. If you do not agree, do not use the Site. The Site is provided for real-estate information and contacting Laurier Tremblay. You may not use it for unlawful activity, unauthorized automated extraction, technical interference, or unauthorized commercial reuse.
3. INFORMATION ONLY; NO CONTRACT OR PAYMENT
The Site does not accept payments, deposits, or agreements. Submitting a form, requesting information, saving a property, or receiving a response does not create a client-advisor relationship, agency, commission, reservation, promise of sale, or obligation to buy or sell. Any professional relationship or transaction requires separate documents and, where applicable, involvement of the brokerage, notary, and other professionals.
4. LISTINGS, IDX AND MLS
Listings may come from IDX, MLS BCS, FlexMLS, iHomefinder, owners, developers, or other sources. Availability, price, features, images, dimensions, and status may change without notice and must be verified before a decision is made. IDX displays must identify the listing office and show the attribution required by the MLS. Some listings displayed courtesy of the IDX program may not be listings of Laurier Tremblay or Baja Surf Realty. MLS/IDX content is for personal, non-commercial use related to a prospective purchase, sale, or lease. Copying, republishing, scraping, or exploiting it without express permission is prohibited.
5. ADVERTISING, PRICES AND CURRENCY
Reasonable efforts are made to keep information and advertising clear, truthful, verifiable, and consistent with NOM-247-SE-2021 and other applicable rules. When a price is shown in U.S. dollars, any Mexican-peso equivalent is informational and must be calculated using the applicable exchange rate on the relevant date. Final price, payment method, closing costs, taxes, fees, inventory, features, and terms must be confirmed in writing. Photos, plans, renderings, estimates, translations, and descriptions do not replace contractual or registry documents.
6. NO LEGAL, TAX, FINANCIAL OR INVESTMENT ADVICE
Content is informational and is not legal, tax, financial, immigration, technical, valuation, or investment advice, and no return is guaranteed. Consult independent professionals and complete due diligence, including title, liens, zoning, permits, physical condition, services, condominium rules, costs, and currency risk.
7. COMMUNICATIONS AND CONSENT
When you request information, Laurier may respond through the contact method you provide to handle that request. This is separate from optional marketing. Promotional email, telephone, or text messages will be sent only where applicable consent exists. You may withdraw consent at any time by writing to laurier@lauriertremblay.com. Marketing consent is not a condition of receiving an inquiry response or purchasing services. Carrier charges may apply to text messages.
8. PRIVACY
Personal-information collection and handling are governed by the Privacy Notice at https://www.lauriertremblay.com/privacy-policy. Consent for a secondary purpose is requested at the relevant collection point; merely using the Site does not constitute consent to optional marketing.
9. INTELLECTUAL PROPERTY
Except for MLS, IDX, and other third-party content, Site text, design, marks, photographs, and other content belong to Laurier Tremblay or are used with permission. No license is granted except the personal use needed to view the Site.
10. THIRD-PARTY LINKS AND SERVICES
The Site may embed or link to Squarespace, iHomefinder, MLS/FlexMLS, maps, social media, and other providers. Their content, availability, and practices are also governed by their own terms. Laurier does not control third-party sites, but this does not limit any rights the law gives you against Laurier where applicable.
11. AVAILABILITY AND SECURITY
The Site is not guaranteed to be uninterrupted, error-free, or free of harmful components. You are responsible for using reasonably secure devices and connections. Laurier may modify, suspend, or remove functions for maintenance, security, or provider changes.
12. REASONABLE LIMITATION OF LIABILITY
To the extent permitted by law, Laurier is not liable for indirect, incidental, or consequential loss arising solely from informational use of the Site or interruptions outside his control. This does not exclude liability for intentional misconduct, gross negligence, fraud, personal injury, breach of legal duties, misleading advertising, or any non-waivable consumer right or remedy. Nothing limits your ability to seek assistance from PROFECO or another competent authority.
13. GOVERNING LAW AND PROFECO
These Terms are governed by the federal laws of Mexico and applicable laws of Baja California Sur. The parties will first try in good faith to resolve a dispute. Consumers retain access to the Procuraduría Federal del Consumidor (PROFECO) and competent authorities or courts. No clause waives any non-waivable right or jurisdiction.
14. CHANGES AND SEVERABILITY
Changes will be posted with a revised effective date and will apply prospectively. If a provision is invalid or unenforceable, the remaining provisions continue to the fullest extent permitted.
